EU suggests tribunals for pirates,

The European Union Security Council put forward the possibility of establishing international tribunals to try pirates, as its members called for tougher legislation aimed at prosecuting and jailing suspects caught off the coast of Somalia. In a resolution unanimously adopted, the 15-member body appealed to all States "to criminalize piracy under their domestic law and favorably consider the prosecution of suspected, and imprisonment of convicted, pirates apprehended off the coast of Somalia, consistent with applicable international human rights law."
The Security Council also requested that Secretary-General Ban Ki-moon present a report within three months on possible options for prosecuting and imprisoning suspects in connection with piracy and armed robbery at sea in the Horn of Africa. In its resolution, members noted efforts by the UN Office on Drugs and Crime (UNODC) and other international organization and donors, including the Contact Group on Piracy off the Coast of Somalia (CGPCS), "to enhance the capacity of the judicial and the corrections systems in Somalia, Kenya, Seychelles and other States in the region."
Ongoing violence between the TFG, heavily backed by the African Union Mission in Somalia (AMISOM) and other supporters, and rebel groups in Somalia’s capital of Mogadishu prevents piracy suspects from being tried or imprisoned there. Some of the burden has shifted to neighboring Kenya’s justice system.
Meanwhile, on Friday in Virginia, nine of eleven Somali suspects were arraigned in a Norfolk courtroom for their pleas on piracy charges and related offenses. They are suspected in separate attacks on a pair of Navy ships – the
USS NICHOLAS and the USS ASHLAND. According to the first six-count indictment returned on April 20, 2010, five men – Mohammed Modin Hasan, Gabul Abdullahi Ali, Abdi Wali Dire, Abdi Mohammed Gurewardher, and Abdi Mohammed Umar – left Somalia in search of a merchant ship to pirate. They allegedly used two smaller vessels loaded with assault weapons and a rocket propelled grenade (RPG) that served as attack boats, along with a larger ship full of supplies. The nine men pleaded "not guilty." One other also pleaded "not guilty" last week and the 11th alleged pirate will be arraigned next week. The suspects will be held until their trials which are tentatively set for July.This indictment alleges that on March 31, 2010, Hasan, Ali, and Dire boarded one of these smaller vessels and set out to pirate and plunder what they believed to be a merchant ship. Ali and Dire each allegedly carried an assault weapon, and Hasan allegedly carried an RPG. The indictment charges that they opened fire on the ship, which they soon sadly discovered was the
USS NICHOLAS. The remaining two individuals charged in the indictment – Gurewardher and Umar –remained onboard the large ship to maintain that ship during the alleged attack. In a second five-count indictment, six men – Maxamad Cali Saciid, Mohammed Abdi Jama, Jaamac Ciidle, Abdicasiis Cabaase, Abdirasaq Abshir and Mahamed Farraah Hassan – were charged with piracy-related offenses involving the USS ASHLAND on or about April 10, 2010. MERCY TO DELIVER ANTIQUITIES TO CAMBODIAThree Cambodian antiquities were delivered to the M.E.B.A.-crewed hospital ship
USNS MERCY (T-AH 19) on April 15 in San Diego, after being recovered by U.S. Customs and Border Protection agents. The recovered items, including an intricately carved bas-relief sandstone sculpture and a sandstone bust and torso, were estimated by archaeologists to have been created between 1000-1500 A.D. "I am happy to be able to facilitate the return of these antiquities to the people of Cambodia," said Matthew Bush, MERCY's Chief Mate. "It's a privilege to be a part of our continuing good relations with the Cambodian people."The sculptures have both historical and religious significance, and their return to Cambodia is especially noteworthy. The items were smuggled to Thailand and then to India, where they were intercepted by Indian authorities and delivered to the United States. The U.S. Customs Service and Border Protection Agency estimates the total antiquity black market trade to be $10 billion annually. The items will be returned by
MERCY to Cambodia this summer during the ship's involvement in Pacific Partnership 2010. Pacific Partnership 2010 is aimed at strengthening regional relationships with host and partner nations in Southeast Asia and Oceania. It is designed to enhance these relationships through medical, dental,veterinary and engineering outreach projects that reinforce the mutually supporting roles between participants. ONE LAST VSO COURSE AT L.A./WILMINGTON HALLOne more VSO course is scheduled to be held at M.E.B.A.’s Union hall in Wilmington, CA. The first of three took place in late March for three days and was taught by Robin Reighley from Training Resources, Ltd, Inc. out of San Diego, CA. The next class was held on April 27-29 and was an equal success.
The final course is set for May 25-27, a newly rescheduled date. Members enrolling in the upcoming course must have 30 days of covered employment by a company that pays into the training plan in order to be eligible to attend. SEAFARERS SAFE HAVEN RESIDENCE HAS OPENINGS FOR RETIRED MARINERSSeafarers Safe Haven at the Prospect Park YMCA in Brooklyn has several permanent rooms available for retired seafarers. These rooms are complemented by a communal lounge with cooking facilities, a comfortable seating area and a library. This shared space fosters a strong community among the seafarers, and a sense of connection with the broader community of the Prospect Park YMCA. Residents can use the recreational facilities at the YMCA, and have access to surrounding institutions including the Brooklyn Botanical Gardens, Brooklyn Public Library and Prospect Park. The development of the residential facility has served as a springboard for the development of programming for the retired seafarers. Special activities and events are developed based upon the interests of residents and have included trips to the maritime museum in Mystic, Connecticut, special dinners for the residents, movies and discussion groups.
Seafarers Safe Haven currently has several vacancies available. Applicants for Seafarers Safe Haven must meet the following eligibility requirements: Seafarer must be retired from active maritime service; Seafarer must have at least ten years of seatime (vacation time not to be included in seatime total) documented by discharges and US Coast Guard records; Seafarer must be receiving social security and/or pension benefits. Income cannot exceed $28,000 per year; the seafarer must be clean, sober and able to handle semi-congregate living. VITTER RECEIVES "SALUTE TO CONGRESS" AWARDU.S. Sen. David Vitter (R-LA) was awarded the International Propeller Club of the United States’ "Salute to Congress Award" for 2010. The award, which was presented at the annual Salute to Congress Dinner on Tuesday, is given each year to a member of Congress who has demonstrated consistent support for the United States-Flag Merchant Marine and the maritime industry in the United States. "It is extremely humbling to receive this honor in my first term in the Senate," Vitter said. "I remain committed to the work of the Propeller Club and I understand how important the maritime industry is to our economy and our military. For the United States to remain a dominant economic power, we must remain a great sea power, and we must continue to lead the way in commercial maritime activity. This award will refocus my energy towards these important issues even more."

EPA FINALIZING EMISSIONS STANDARDS FOR NEW MARINE DIESEL ENGINESThe environmental Protection Agency is finalizing emission standards for new marine diesel engines with per-cylinder displacement at or above 30 liters (Category 3 marine diesel engines) installed on U.S. vessels. These emission standards are equivalent to those adopted in the amendments to Annex VI to the International Convention for the Prevention of Pollution from Ships (MARPOL Annex VI). The emission standards apply in two stages--near-term standards for newly built engines will apply beginning in 2011; long-term standards requiring an 80 percent reduction in NOX emissions will begin in 2016. They are also finalizing a change to their diesel fuel program that will allow for the production and sale of 1,000 ppm sulfur fuel for use in Category 3 marine vessels. In addition, the new fuel requirements will generally forbid the production and sale of other fuels above 1,000 ppm sulfur for use in most U.S. waters, unless alternative devices, procedures, or compliance methods are used to achieve equivalent emissions reductions. This final rule is effective on June 29, 2010.
